Nearth（ニアース）は、AIキャラクターとのコミュニケーションを楽しむためのサービスです。ユーザーは自分だけのAIキャラクターを作成し、チャットやタイムライン機能を通じて交流できます。
Nearth is a service for enjoying communication with AI characters. Users can create their own AI characters and interact through chat and timeline features.
2. アカウント2. Account and Age Restriction
・本サービスは13歳以上の方を対象としています ・13歳未満の方はご利用いただけません ・1人につき1アカウントのみ登録できます ・アカウント情報（メールアドレス、パスワード）の管理はユーザーの責任となります ・第三者へのアカウント譲渡・共有は禁止します ・不正アクセスを発見した場合は速やかにご連絡ください
• This service is intended for users aged 13 and older • Users under 13 years of age are not permitted to use this service • Each person may register only one account • Users are responsible for managing their account information • Transfer or sharing of accounts to third parties is prohibited • Please contact us immediately if you discover unauthorized access
3. 禁止事項3. Prohibited Activities
以下の行為を禁止します： ・違法行為、またはそれを助長する行為 ・他者の権利を侵害する行為 ・わいせつ、暴力的、差別的なコンテンツの作成 ・サービスの運営を妨害する行為 ・リバースエンジニアリング、不正アクセス ・商用目的での無断利用 ・その他、当社が不適切と判断する行為
The following activities are prohibited: • Illegal activities or promoting illegal activities • Infringement of others' rights • Creating obscene, violent, or discriminatory content • Interfering with service operations • Reverse engineering or unauthorized access • Unauthorized commercial use • Other activities deemed inappropriate by us
4. AIに関する注意事項4. AI Disclaimer
・AIの回答は常に正確とは限りません ・AIキャラクターは架空の存在であり、実在の人物ではありません ・重要な判断にはAIの回答のみに依存しないでください ・AIの回答内容について、当社は責任を負いません
• AI responses may not always be accurate • AI characters are fictional and do not represent real persons • Do not rely solely on AI responses for important decisions • We are not responsible for the content of AI responses
5. ユーザーデータの取扱い5. User Data Handling
ユーザーが入力した情報（チャット内容、キャラクター設定、プロフィール情報など）は、サービス提供のためにのみ使用します。当社はこれらの情報を第三者に提供・公開することはありません。また、AIモデルの学習目的での利用も行いません。
Information entered by users (chat content, character settings, profile information, etc.) is used solely for service provision. We do not share or publish this information to third parties. We also do not use this data for AI model training purposes.
6. 課金・返金6. Billing and Refunds
・有料プラン（サブスクリプション）は自動更新されます ・解約は更新日の前日までに行ってください ・決済はご利用のプラットフォームに応じて、Stripe・App Store・Google Play Storeを通じて処理されます ・返金については各プラットフォームの規約および当サービスの返金ポリシーに基づき、原則として対応しておりません
• Paid plans (subscriptions) are automatically renewed • Please cancel before the renewal date • Payments are processed through Stripe, App Store, or Google Play Store depending on your platform • In principle, refunds are not available based on the respective platform policies and our refund policy
7. 退会・データ削除7. Account Deletion
・退会時は、作成したキャラクター、チャット履歴、その他すべてのユーザーデータを削除します ・データ削除後の復旧はできません ・退会手続きは設定画面から行えます
• Upon account deletion, all user data including characters, chat history, and other data will be deleted • Data cannot be recovered after deletion • Account deletion can be performed from the settings screen
8. 生成コンテンツの権利8. Generated Content Rights and Copyright Notice
AIが生成したコンテンツ（チャットの返答、タイムライン投稿など）の権利は、生成を依頼したユーザーに帰属します。ただし、利用規約に違反するコンテンツの生成・使用は禁止します。 【著作権に関する注意事項】 ・使用するアイコン・画像が既存の著作物に類似していないか確認する責任はユーザーにあります ・第三者の著作権、肖像権、商標権を侵害するコンテンツの使用は禁止します ・権利侵害の申立てがあった場合、当該コンテンツを削除する場合があります
Rights to AI-generated content (chat responses, timeline posts, etc.) belong to the user who requested the generation. However, generating or using content that violates these terms is prohibited. [Copyright Notice] • Users are responsible for verifying that icons and images they use do not resemble existing copyrighted works • Content that infringes on third-party copyrights, portrait rights, or trademark rights is prohibited • Content may be removed if claims of rights infringement are received

・サービスの継続的な提供を保証するものではありません ・システム障害、メンテナンスによる一時停止の可能性があります ・ユーザー間またはユーザーと第三者間のトラブルについて、当社は責任を負いません ・本サービスの利用により生じた損害について、当社の故意または重過失による場合を除き、責任を負いません
• We do not guarantee continuous service provision • Service may be temporarily suspended due to system failures or maintenance • We are not responsible for disputes between users or between users and third parties • We are not liable for damages arising from use of this service, except in cases of our gross negligence or willful misconduct
10. 規約の変更・サービスの終了10. Changes and Termination
・本規約は予告なく変更される場合があります ・重要な変更の場合は、アプリ内通知またはメールでお知らせします ・当社はサービスを終了する権利を有します ・サービス終了の場合は、事前に告知を行います
• These terms may be changed without notice • Important changes will be notified via in-app notification or email • We reserve the right to terminate the service • Advance notice will be given in case of service termination
11. 準拠法・管轄裁判所11. Governing Law and Jurisdiction
本規約は日本法に準拠します。本サービスに関する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
These terms are governed by Japanese law. The Tokyo District Court shall have exclusive jurisdiction in the first instance for any disputes related to this service.
